Apple Requests Sanction for Samsung The bickering in the high-profile Apple-Samsung patent-infringement lawsuit continued for the third day in San Jose U. S. District Court on Wednesday, with Apple requesting Judge Lucy Koh to sanction Samsung and its lawyer John Quinn for releasing disputed evidence in the case to the press.

Apple said in its most recent filing, which was made public on Thursday, that Samsung and its attorney had apparently tried to "prejudice the jury" and that the release of the disputed evidence by them amounted to engaging in "bad faith litigation misconduct." Requesting Judge Koh to "severely sanction Samsung," Apple said that the court "should not condone this behavior."

The harsh wording which Apple used in its filing marked the company's strong reaction to the rather unusual move by Samsung --- that of sending across that evidence to the reporters which had been blocked by the courts.

According to Quinn, the documents which Samsung had sent to the reporters revealed that Apple's iPhone was "inspired" by Sony's devices. When Judge Koh demanded that Samsung explain its unusual move, a declaration by Quinn said that the move was "lawful" and "ethical" in part as the materials were already in the public domain.

Though Quinn added that the `release of documents' move was not designed to influence the jurors in the case, Apple said in its filing that Samsung's actions "undoubtedly substantially increased the risk that the jury will see - or, at a minimum, be influenced by someone who has seen - precisely the evidence the Court has excluded."
