Close on the heels of issuing a preliminary injunction banning the US sales of Samsung’s Galaxy Tab 10.1 on June 26, U. S. District Judge Lucy Koh in San Jose, California, Friday barred Samsung from selling its Nexus smartphone in the country.
The latest verdict by Judge Koh is the second court ruling this week in the Apple-Samsung global patent-infringement scuffle. Both the bigwig manufacturers of high-end smartphones have been accusing each other of copying designs as well as technology for mobile devices. The two companies are currently fighting patent lawsuits in four continents, in an attempt to retain their market-leading position in the $219 billion smartphone market worldwide.
In her Friday order, which has barred Samsung from selling the Nexus handset in the US, Judge Koh said that Apple had shown that four of the company’s patents are likely valid and had been violated by the Samsung handset.
Disappointed with the verdict, Samsung argued in a recent court filing that the court’s ruling relied on old evidence, and judge Koh had refused to consider newer evidence which demonstrates the invalidity of the patent in dispute in the case.
Noting that the ruling will “restrict U. S. consumer choice in the smartphone market,” Samsung spokesman Adam Yates said in an emailed statement that the company will “take all available measures, including legal action, to ensure the Galaxy Nexus remains available to consumers.”
